My passion for this area of the law is personal. After a family member was wrongfully terminated, I dedicated myself to these issues to learn how the laws work and help others in need.

While employment in California is at-will — employers can terminate workers for any legal reason — employees do have inalienable rights. Employers cannot terminate, discriminate against, promote, assign jobs to or set wages of workers based on:

  • Age
  • Disability
  • Gender
  • National origin
  • Pregnancy
  • Race
  • Religion
  • Sexual orientation

Additionally, employers must follow their own stated procedures and policies with regard to termination, and they cannot terminate workers for:

  • Filing discrimination or safety claims
  • Reasons not included in an employment contract (assuming one is in place)
  • Refusing to break laws
  • Taking leave under the Family and Medical Leave Act
  • If one or more of these circumstances apply to you, legal action levels the playing the field and stands to help you regain your financial footing.

Whistleblower and Retaliation

The U.S. Occupational Health and Safety Administration administers 17 statutes that protect so-called whistleblowers from retaliation for exercising rights allowed under various acts including filing complaints with government agencies about workplace safety or health hazards.
