While employment in California is at-will — employers can terminate workers for any legal reason — employees do have inalienable rights. Employers cannot terminate, discriminate against, promote, assign jobs to or set wages of workers based on:

- Sexual orientation
Additionally, employers must follow their own stated procedures and policies with regard to termination, and they cannot terminate workers for:
- Filing discrimination or safety claims
- Reasons not included in an employment contract (assuming one is in place)
- Refusing to break laws
- Taking leave under the Family and Medical Leave Act

Whistleblower and Retaliation
The U.S. Occupational Health and Safety Administration administers 17 statutes that protect so-called whistleblowers from retaliation for exercising rights allowed under various acts including filing complaints with government agencies about workplace safety or health hazards. Other U.S. Department of Labor agencies that enforce anti-retaliation provisions are:
- Wage and Hour Division
- Employee Benefits Security Administration
- Mine Safety and Health Administration
Similar protections are afforded in California. Instances of workplace retaliation, also called Qui Tam actions, are investigated by the Retaliation Complaint Unit in the Division of Labor Standards Enforcement.
